AGYBO S.A.S. ("AGYBO") is a company established under Colombian law, identified with NIT No. 901.410.235 – 1, domiciled in the city of Bogotá D.C., which presents the following terms and conditions of use (hereinafter, the "Terms and Conditions") that regulate access to and use of our website to its users.

ACCEPTANCE OF TERMS AND CONDITIONS

By pressing the button to accept the Terms & Conditions before making each of your purchases, you expressly and unequivocally state that you have read, accept, and agree with the Terms & Conditions set forth herein. If you do not agree, please refrain from using this website.

The Terms & Conditions may be updated or modified at any time unilaterally by AGYBO, so we recommend reading this section before making your purchases.

PRODUCT DELIVERY POLICY

Delivery Times

AGYBO is committed to meeting delivery times. Therefore, our deliveries will be made as follows:

  • In Bogotá, deliveries will be made within a maximum of two (2) business days.
  • In Medellín, deliveries will be made within a maximum of five (5) business days.
  • In major cities of Colombia, deliveries will be made within a maximum of eight (8) business days.
  • In the rest of the country and international destinations, deliveries will be made within a maximum of ten (10) business days.
  • Delivery times will start counting from the day the transaction is confirmed. AGYBO will send you a message when this happens.
  • Delivery schedules may vary. Deliveries will not be made on Sundays.
  • AGYBO will deliver the products to you, to the person you authorize, or to whoever is at your address at the time of delivery. AGYBO will not be responsible for any issues that arise due to delivery errors caused by incorrect or inaccurate addresses.

Shipping Costs

  • The shipping cost in the city of Bogotá is $8,000.
  • The shipping cost in the rest of the country's cities is $12,000.
  • The cost of international shipping will be calculated depending on the destination and will be reflected before placing the order.

EXCHANGE POLICY

At AGYBO, customer satisfaction is very important to us. Therefore, to exchange a product purchased on our website, please consider the following:

  • You have thirty (30) calendar days from the delivery date to request an exchange.
  • We only accept exchanges for size.
  • To make the exchange, products must be in optimal condition, clean, without makeup, oils, creams, or similar residues, and with all tags and labels as delivered.
  • In case of exchanges, the transportation cost must be borne by you. We do not accept products sent COD (Cash on Delivery).
  • Exchanges must be made for products available at the time of the exchange.
  • Garments obtained through exchanges cannot be exchanged again.
  • Products on promotion or discount are not eligible for exchange.

Procedure for Exchanges

To request an exchange, please write to us at info@agybo.com, requesting the exchange of your product and providing the following information:

  • The invoice or your order information (date, buyer's name, ID, order number, and a photo of the unused product).
  • The size you want to exchange for.

WARRANTIES

If any AGYBO product has a quality, suitability, safety, or proper functioning issue, you can request a warranty.

Our products have a warranty of thirty (30) calendar days.

The warranty period starts from the day we deliver the product.

Procedure for Exercising the Warranty

To file a warranty claim, you must send us an email at info@agybo.com requesting the warranty for your product and providing the following information:

  • The invoice or your order information (date, buyer's name, purchased product).
  • Attach a photo indicating the defect in the product.

Once the request is made, AGYBO will contact you to guide you on how to deliver the product and proceed with the process. In this case, AGYBO will cover transportation costs. Once the product is received, AGYBO's specialized personnel will review it and inform you of the technical reasons for approving or denying the warranty. If the warranty is denied, we will inform you of the reasons and return the product by the same means you received it.

Please note that AGYBO may be exempt from providing the warranty if the following occurs: i) force majeure or fortuitous event, ii) a third party's action, and iii) improper use on your part. Therefore, we suggest reading the information we provide about recommended sizes, colors, and materials carefully and following the instructions to use and maintain your garments properly.

If AGYBO enforces the warranty, we will inform you if the product can be repaired. If it cannot be repaired or a second failure occurs, you may choose between a credit balance for our website, a refund, or a brand-new identical product.

If the product you purchased is unavailable, you may choose between a credit balance for our website or a refund.

RIGHT OF WITHDRAWAL

The right of withdrawal allows you, as a consumer, to cancel your purchase and return the product delivered in the same condition you received it.

Procedure for Exercising the Right of Withdrawal

To exercise the right of withdrawal, you have five (5) business days from the day after the product is delivered.

To make your request, send us an email at info@agybo.com stating that you wish to exercise your right of withdrawal and that you will return the purchased product.

In this case, transportation costs must be borne by you. We suggest keeping proof of the shipping date.

The product must be returned within a maximum term of five (5) business days from the day after delivery, in the same condition as delivered: completely new, in optimal condition, without any signs of use, free from makeup, oils, creams, or similar residues, clean, in good condition, and with tags and labels as delivered.

Upon receiving the request and the product as described, AGYBO will refund the money within no more than thirty (30) calendar days from the day after notifying your right to withdraw.

PAYMENT REVERSAL

Payment reversal will be applicable for purchases made on our website under the following circumstances:

  • You were a victim of fraud.
  • It corresponds to an unsolicited operation.
  • You did not receive your product within the established times.
  • The delivered product does not match what you ordered.
  • The delivered product is defective.

Procedure for Payment Reversal

To request payment reversal, you have five (5) business days from the day after becoming aware of the unsolicited or fraudulent operation, the day you received a defective or incorrect product, or the day you should have received your product and did not.

To make the request, you must email info@agybo.com indicating:

  • The reasons for the payment reversal request.
  • The applicable reason from the above list.
  • The amount for which you request the reversal.
  • The payment instrument used for the transaction or the one charged.
  • The invoice or order information (date, buyer's name, purchased product, reference, order number), if applicable.

Within the same five (5) business days, you must notify your financial entity of the payment reversal request with the same information sent to AGYBO.

If you have received the product, you must return it in the same condition you received it: completely new, in optimal condition, without any signs of use, free from makeup, oils, creams, or similar residues, clean, in good condition, and with tags and labels as delivered.

AGYBO will cover the transportation cost and will contact you to guide you on the product delivery procedure.

This right does not apply if your financial entity is not domiciled in Colombia.

INTELLECTUAL PROPERTY

The intellectual property rights to the website and all content published on it are the exclusive property of AGYBO. The reproduction, copying, alteration, modification, dissemination, or total or partial reuse of any material published on the website is expressly prohibited without prior express written authorization from AGYBO.

AGYBO reserves the right to take any actions it deems appropriate to defend its rights. Nothing contained on the website shall be interpreted as granting any license or right to use any Intellectual Property Right without AGYBO's usage license. All AGYBO content is fully protected by copyright, and any use other than the purposes provided here may constitute the commission of crimes typified in articles 270, 271, and 272 of Law 599 of 2000.

PLATFORM AVAILABILITY

AGYBO does not guarantee the availability or operation time of the website. In case of instability or major technical issues, AGYBO will not be liable to consumers but will make its best efforts to stabilize its operation.

APPLICABLE LAW

These Terms and Conditions are governed by the applicable law in the Republic of Colombia.
